In accordance with Article 6 of the Law of July 29, 1882, and Decree No. 87-246 of April 6, 1987, as well as Point IV of Article 6 of the Law of June 21, 2004, I hereby exercise my right of reply.
In an unsigned post published on 02/14/2025 at 4:10 PM on the (Propriétaires / Owners Cap Coudalère) website, the Amicale des Copropriétaires de Cap Coudalère (A3C) is repeatedly called into question within a diatribe filled with falsehoods. This text clearly seeks to discredit A3C’s actions and to dishonor its members.
I quote:
"Certain influential members of this association have engaged in maneuvers aimed at destabilizing the operation and management of ASLIC."
"A3C has no legal legitimacy to interfere in Coudalère’s affairs or disrupt its proper functioning."
"An unacceptable and illegitimate interference."
The unsigned text provides no tangible evidence of any alleged destabilization, disruption, or interference in ASLIC’s operations and management. I remind you that A3C is neither directly nor indirectly involved in any form of co-management of ASLIC and in no way affects its activities. These accusations therefore amount to defamation, as defined in Article 226-10 of the Penal Code.
"To achieve their goals, they use all possible methods, including the most questionable ones: sensationalist and populist publications, reminiscent of the most tabloid-style journalism, directly distributed in mailboxes, filled with lies, slander, distortions of facts, and unfounded rumors."
"Even more concerning, in 2024, a website was launched, repeating these allegations and distortions, thus amplifying misinformation. We invite you to visit it to assess the degree of manipulation and malice of its contributors."
Aside from the fact that A3C has never distributed any publications in mailboxes, the unsigned text insinuates that the information it disseminates is false, slanderous, and based on unfounded rumors. On what basis are these accusations made? The anonymous text you have published provides no evidence for such claims, which constitutes the offense of false accusation, as stipulated in Articles 226-10 to 226-12 of the Penal Code.
"Thus, on June 18, 2024, during ASLIC’s General Assembly, five members of A3C, representing less than 10% of property owners, obtained the majority and decision-making power."
"That day, these five individuals decided not to approve the 2023 financial accounts."
The anonymous text spreads false statements regarding the deliberation results recorded by ASLIC, particularly concerning the vote on the approval of the 2023 accounts, which was rejected by 55.86% of the votes present or represented at the General Assembly—far from the figures stated by the author of the text.
"Beyond the unhealthy climate created by A3C at the Coudalère site, the incessant quarrels and unfounded rumors they spread result in a waste of time and efficiency for ASLIC teams, leading to financial losses for all co-owners."
The anonymous text attributes a moral and financial burden to ASLIC and its members without presenting any evidence, shifting onto A3C certain responsibilities that some parties refuse to assume. Once again, this is a case of slander conveyed through a deceitful and cowardly written statement.
The association I have the honor of presiding over consists of several hundred members, all property owners and members of ASLIC. Created under the framework of the Law of July 1, 1901, it enjoys the right of free association and has every right to inform and criticize in the defense of its members' personal and material interests. It will continue this mission with unwavering determination, in full compliance with the law.
I therefore urge you to cease associating yourself with the dissemination of slanderous and false statements targeting A3C and its members, failing which you will be held accountable in court.
