A copy of Mr. Gieloff’s letter is to be read after our response.
Dear M. Gieloff
It is in my capacity as President of the Association of Co-owners of Cap Coudalère (A3C) that I address you. I have recently read a letter you sent to all the co-owners of the Palmyra residence, whose Council of Trade Unions you are chairing.
If it is not my place to give an opinion or a judgment on the information that concerns the operation of your condominium, I think it necessary to return to the comments you make about my association and more particularly its members.
First of all, I note that you have a hard time mastering the operation of ASLIC and its bodies since you call it the “Union Council of ASLIC”, which is simply the “Syndicat”. You then call “delegates”, the representatives elected at the general meeting of co-ownership. May I remind you that the co-owners of your residence will not vote to elect their delegate. The latter will be designated by the AG of ASLIC!
Finally, I note that you insist on mentioning the A3C in a direct or indirect way on the occasion of the next elections which will allow the constitution of a new general assembly of the ASLIC responsible for electing the delegates of each co-ownership.
On 6 occasions you call the attention of the co-owners of Palmyra to “vote well” first for your Council and especially for the appointment of the representative at the general assembly of ASLIC (and not for the position of delegate to the union of ASLIC as you claim).
Such a directive would not have caused me to react if it had not been accompanied by discriminatory and malevolent remarks against the association I have the honour of chairing and its members.
I quote you:

“we invite you to entrust your “powers” to persons not part of the A3C”
“Think carefully to whom you are granting your power of attorney”
This anthology has trouble hiding a fear that seems to invade you suddenly! But what kind of fear is it? What political objectives are you talking about? Which active minority do you complain of? The one who did not approve the ASLIC accounts in June 2024? Do you fear co-owners who dare to ask for explanations about the charges they are asked to pay? Why do you ostracize the A3C and its members who do not share your blindness or naivety?
I want to reassure you in the most direct way possible: the A3C and its members represent only a group of owners anxious to live peacefully on the site of La Coudalère but also committed to the defense of their interests when it comes to the management and maintenance of this site.
These owners expect more transparency, more rigor in the use that is made of their charges and above all to be heard.
I can only advise you to work in this direction rather than to belittle those who do not think like you.
I will conclude by quoting the writer Georges Elgozy: “Demagogy is to democracy what prostitution is to love.”

Details of key points
Important decisions in 2025
Two major decisions will have to be made in 2025:
1. The election of a new Union Council for a three-year term.
2. The election of Palmyra’s representative to the ASLIC (Association
Syndicale Libre Ile Couladère).
We understand that many of you are looking for tranquility and want to enjoy your vacation. However, participation is essential to avoid that decisions are not made by an active minority.
Status of the Legal Proceedings against CITYA
On January 7, 2025, we met with Maître Kassubek, our lawyer in charge of the case
the first hearing on April 4, 2024 was postponed at the request of counsel for
the Citya insurance, as of 14 November 2024 and a second time on 10 April 2025 , invoking
a lack of documentation from Citya. Now, the date is set for April 10, 2025,
regardless of CITYA’s ability to provide other elements. Our lawyer insists that
is very important to fix the shutters and especially not to leave them open or closed without blocking them.
Technical problems of the components
Since the start of the procedure in 2022, a significant increase in defects has been
found:
• Inadequate fasteners: Some flaps have come off due to non-conforming fasteners.
• New disorders: causing the collapse of many
• Corrosion: Progressive corrosion has been observed on many fronts during
the year.
These problems are unacceptable. At the General Assembly before the renovation, the
co-owners had voted for quality “Qualicoat” flaps. However, Ms
Bernard of CITYA changed this decision unilaterally by ordering
quality «Thermolaqué», while accepting inappropriate fasteners (Composite instead
of INOX).
Responsibility of CITYA
Following the file prepared by the Conseil Syndical Palmyra, CITYA admitted its fault in
taking over the work of securing the shutters, by Rivesaltes ALU, at no cost to
the co-ownership. This clearly shows that they are aware of their responsibility.
Obstacles to a quick solution
The main obstacle does not come from CITYA itself, but from its assurance and
lawyers. These block any quick resolution, although the current situation also damages CITYA’s image.
We do everything possible to avoid a long and costly procedure. Our goal
is to find a quick agreement with CITYA, provided that their insurance does not oppose it
The director of CITYA du Barcarès, Mr. PONS, prefers a good deal
friendly rather than a lengthy procedure and seems to agree for a joint expertise, in
course of proposal from our lawyer.
Expertise and evidence to provide
Expertise is required to demonstrate the inferior quality of installed shutters and
Corrosion progression:
• Common expertise: Our lawyer is responsible for reaching an agreement with CITYA and their
Lawyer to order joint expertise, less expensive than independent expertise.
• Evidence:
o The installed shutters do not correspond to the quality «Qualicoat».
o "Qualicoat" is significantly more resistant to corrosion than "Thermolaqué".
o The shutters show progressive corrosion since their installation.
The 2022 expert report by Mr. Asseraf (Honorary Expert) is no longer relevant, but it remains useful for assessing the evolution of the damage.
Financial risk management
The costs of expertise and proceedings shall be borne by the losing party. However, we want to minimize the financial risks for the co-ownership. If the joint expertise is refused by the insurance company, it is the General Assembly of 2 May that must decide on the action to be taken. All new information will be passed on to you in due time.
Call for voting and delegation of powers
To allow us to defend your interests and also avoid a break in the
